
Cookie law: campaign of data protection

Communication campaigns are aimed at raising public awareness on specific issues regarding the protection of personal data and their disclosure. A few days from a new campaign that has Cookies as protagonists, information entered on the broswer when a user visits a website or use a social network with your PC, smartphone or tablet, let’s see what there is to know about “cookie law”.
The initiative of the Privacy aims to curb the spread of profiling cookies and related risks to the privacy of users. We can say that the use of cookies , in a website, must be previously accepted by the user, who must give their informed consent. Before he can give legal consent, the user must be properly informed about the use of cookies in the site. This must occur in two different stages:
- The website owner must analyze what cookies are used and installed
- According to the analysis performed, the owner of the site has to observe some technical requirements which differ according to cookies used:
- If your site uses technical cookies, it is not necessary the banner and it is sufficient to manage the information about cookies within the appropriate information or in the privacy policy of the website;
- If your site uses cookies profiling of first parts you will need to manage a short informative (to be supplied through a special banner that appears immediately on the home page or other landing page) and a wide information (whose link must be indicated already in the banner and then made always available during navigation in order to allow easy access to the specific information about cookies used), obtain from user, before the installation of cookies on your terminal, express consent (with the click of a button inside the banner, the selection of an internal link to the visited page or scroll action) and make a notification to the Data Protection Authority;
- If your site uses cookies first parts only technical, but allow the installation of third-party cookies profiling, apply the obligations described above, and then it will be necessary block cookies of third parties until the user do not give his consent and manage special banner containing an short informative, supplemented by an extended informative (in which will be described cookies installed by the site and accompanied by links to sites and consent forms of third parts).
We must therefore be very careful in the preparation of management the relationship with their users/customers. Creating your own documentation in a confused way, using simple copy/paste from websites that offer ‘apparently’ similar services or standard it is the most dangerous we can do.
Probably the transition from theory to practice is not simple and immediate, but with the right tools of survival, it is certainly possible!
